These Terms of Service (“Terms”) are a binding agreement between you and Squared Lemons Ltd (“we”, “us”) governing your use of PodMule(the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Beta service
The Service is provided as a beta: it is under active development, may change or be discontinued, and may contain errors or experience interruptions. We may modify or remove features and may impose or change usage limits at any time.
2. Accounts
You must provide accurate information, keep your account secure, and are responsible for activity under your account. You must be at least 18 years old and able to enter into a contract. You are responsible for your team members’ use of your workspace.
3. Your content
You retain ownership of the audio, transcripts, contacts, and other content you upload or generate (“Your Content”). You grant us a licence to host, process, and transmit Your Content as necessary to operate and provide the Service, including sending it to the sub-processors described in our Privacy Policy.
You are responsible for Your Content and confirm that you have the rights and lawful basis to upload it — including any necessary consents from interview guests and other individuals whose personal data it contains.
4. Acceptable use
You agree not to:
- upload unlawful, infringing, or harmful content, or content you have no right to use;
- attempt to disrupt, reverse-engineer, or gain unauthorised access to the Service;
- use the Service to violate others’ privacy or intellectual-property rights;
- resell or provide the Service to third parties except as permitted; or
- misuse AI features to generate unlawful or deceptive material.
5. AI-generated output
The Service uses AI to generate transcripts and content. AI output may be inaccurate, incomplete, or unsuitable, and is not professional advice. You are responsible for reviewing output before relying on or publishing it.
6. Knowledge Base and captured sources
The Service lets you build a per-show Knowledge Base by adding Knowledge Sources— for example a web page, a YouTube, TikTok, Instagram or X post, or a pasted note. When you add a Knowledge Source you instruct us to fetch, store, transcribe, and analyse that material so it can inform your show’s AI features. Where a source contains media, we may download and store a copy in your workspace so your Knowledge Base does not depend on the original remaining available.
You confirm that you have the right to provide each source for this purpose. This ingestion is solely to power features within the Service. Any further use of captured third-party material — including downloading, republishing, redistributing, or otherwise reusing it — is your responsibility and at your own risk, and you must ensure you hold the necessary rights. We are not liable for your use of captured third-party content.
7. Credits, plans and billing
Paid features consume credits or run on a plan. Prices, credit costs, and plan terms are shown in the app and may change. Payments are processed by Stripe. Except where required by law or expressly stated, charges are non-refundable. You are responsible for applicable taxes.
8. Intellectual property
The Service, including its software, design, and trademarks, belongs to Squared Lemons Ltdand its licensors. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service; no other rights are granted.
9. Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or terminate access if you breach these Terms, to protect the Service or other users, or if we discontinue the beta. On termination, your right to use the Service ends; we will handle Your Content as described in the Privacy Policy.
10. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or fit for a particular purpose.
11. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential losses, or loss of data, profits, or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law. We strongly recommend you keep your own copies of important content.
12. Changes to these Terms
We may update these Terms. For material changes we will ask you to review and accept the updated Terms when you next use the Service. Continued use after changes take effect means you accept them.
13. Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, subject to any mandatory rights you have under local law.
